To contemplate on your scenario, after the butt weld of pipe to elbow, your construction team proceeded welding the shoe on elbow ? So as per your statement it is not just kissing with haz but clashing, which means your construction did intentionally, now you're here for correction.

Yes correction can be done as per your above proposal if your company has any standard stating with the clause or if you have a procedure or write and take approval.

One of world's top company standards clause waives your requirement with what you have proposed.

Check SAES-W-011, search for encroachment.
