Lets start with code practice, The throat size or leg length measurements is code specific i.e. EN or ISO code emphasis on throat (a) measurement while the AWS, ASME based on leg length criteria (that what you will generally found in the drawing or refeering AWS A2.4 or ISO 2553.. 
Now referring AWS D1.1, 
AWS D1.1 state that the minimum size fillet weld shall not be smaller than the size required to transmit the applied load ( clause 2.4.2.8) and table 5.7 gives the minimum size of fillet weld required based on base metal thickness involved. The weld measurement of size is the leg length.

while designing or working as per EN/ ISO codes the requirements of minimum and maximum fillet weld is 

Maximum size of fillet weld = 0.7t (where t is the plate thickness, smallest thickness in case of dissimilar thickness involved)
Minimum weld size is based on the application of the weld e.g. for railway the minimum fillet weld shall be 3 mm for aluminium and 2 mm for steel. Here the weld measurement is in terms of throat size. (above is as per EN 15085-3).
For structural welds, design based on DIN 18800-1 is 3 mm.

Above maximum size of fillet weld is based on shear loading criteria. according to which the maximum load that can be transferred by a fillet weld will be 0.7 times of plate thickness. a weld size beyond this will be waste of the resources.

if the T joint ( fillet ) plates thickness are same or different than how do decide throat and leg size without help of drawing ?
