Ali,

0,45% CEq is not so high, it's an intermediate value, cracking could appear in steels with different CEq (low or high) if non adequate welding procedure is used.
Material selection for each element depends on the particular design considerations (loads, temperature, corrosion consideration, etc), if the legs are going to be exposed to low temperatures design must take this in consideration, choosing an improved toughness material.

1-I think Carbon equivalent ranges of up to 0.45% and higher is permitted due to limitation of strength. because even welding use low hydrogen in higher this range the possibility of cracking is high.
 2-Do you have any design reference about category of redundancy of structural member or critically of them. because in previous projects acc. to AGIP or TOTAL spec. these items are primary members and in 8.3.1,8.3.2 use of class A,B or improved toughness property is recommended for legs. 
3- Do you have any example about  application of 11.1.3 b(fabrication sequence)?
